The Central Government follows the principle that disclosure is the norm and non-disclosure the exception, disclosing government information on its own initiative in accordance with the law and safeguarding the public's right to be informed, to participate, to express views and to supervise.
The disclosure regime
In accordance with the Constitution, the laws and the Regulations on Open Government, the Central Government and its departments disclose on their own initiative government information that affects the adjustment of public interests, that the public needs to know widely, or in whose decision-making the public needs to take part; they also provide government information to citizens, legal persons and other organisations on request. Information involving state secrets, commercial secrets or personal privacy is not disclosed in accordance with the law.
Hulian operates an annual reporting system for government information disclosure. Before 31 March each year the General Office of the Central Government publishes the annual report on government information disclosure for the previous year, summarising proactive disclosure, disclosure on request, and administrative reconsideration and litigation arising from disclosure applications, and submits this to public scrutiny.
Citizens, legal persons and other organisations that consider their lawful rights and interests infringed by an administrative organ in the course of government information disclosure may apply for administrative reconsideration or bring administrative litigation in accordance with the law; where disclosed content is considered inaccurate or incomplete, a request for correction may be filed through the Transparency section of the Central Government website.
